There are so many great places  here on Long Island and all over the North East for you to enjoy.  At North East Swingers Alliance we bring you information about some clubs and groups that might interest you. We invite all clubs and groups to post events for new members to enjoy.    Since January we have had 17,128 new visitors to this site (as of August 12, 2008).  Almost all of our visitors are members of many different groups and or clubs.  Our visitors are members almost every group and club the tri-state area and beyond.   This site has information for couples and singles of all interests and growing all the time.  If you would like to submit information about an event please email us.  We enjoy promoting the lifestyle and places that you would feel comfortable at. It is important to understand, on different nights of the week some clubs have different themes, please check in advance, you will find links to clubs all over the North East and Beyond.  The is a place for everyone even if you are new to all of this.  The most popular page has always been our events page.   If you have any questions about a group or a club please email the group owner and they will be happy to speak.  Not all groups are for everyone and some are for everyone.  You will find groups that meet in all different venues.  Be aware of what "off "and "on premise" stands for and the rules that go with them.  All clubs and groups must stay with in state guidelines of whatever license they are operating under.  There are strict laws against having full nudity and a liquor license.  So any club that serve liquor has go be off premise, Please to not attempt to play at an off premise club.  You will be putting violate the law and put the club at risk.  All off premise club have strict rules about this.  The on premise clubs may not server alcohol, these parties are BYOB,  Juices, water and soda are often complementary.

The People in this case have not refuted this evidence or attempted to show the existence of evidence of their own to indicate that the non-lewd exposure of the female breast is in any way harmful to the public's health or well being. Nor have they offered any explanation as to why, the fundamental goal that Penal Law § 245.01 was enacted to advance--avoiding offense to citizens who use public beaches and parks--cannot be equally well served by other alternatives (see, Wengler v. Druggists Mut. Ins. Co., 446 U.S. 142, 151-152, 100 S.Ct. 1540, 1545-1546, 64 L.Ed.2d 107; Orr v. Orr, 440 U.S. 268, 281-283, 99 S.Ct. 1102, 1112, 59 L.Ed.2d 306).

In summary, the People have offered nothing to justify a law that discriminates against women by prohibiting them from removing their tops and exposing their bare chests in public as men are routinely permitted to do. The mere fact that the statute's aim is the protection of ``public sensibilities'' is not sufficient to satisfy the state's burden of showing an ``exceedingly persuasive justification'' for a classification that expressly discriminates on the basis of sex (see, Kirchberg v. Feenstra, 450 U.S. 455, 461, 101 S.Ct. 1195, 1998, 67 L.Ed.2d 428). Accordingly, the gender-based classification established by Penal Law § 245.01 violates appellants' equal protection rights and, for that reason, I concur in the majority's result and vote to reverse the order below.

 

 

1. Public exposure of a female's breast for the purposes of breastfeeding infants or ``entertaining or performing in a play, exhibition, show or entertainment'' is expressly excluded from the statutory prohibition.

2. Significantly, the allegation in Price was that the defendant had been observed on a public street wearing a fishnet pullover which left portions of her breasts visible, prompting the Court to observe that, absent certain conditions, ``legislation may not control the manner of dress'' (33 N.Y.2d, at 832, 351 N.Y.S.2d 973, 307 N.E.2d 46). That consideration is obviously not relevant here, where appellants' conduct was obviously intended as a political, rather than a fashion, statement.

3. Interestingly, expert testimony at appellants' trial suggested that the enforced concealment of women's breasts reinforces cultural obsession with them, contributes toward unhealthy attitudes about breasts by both sexes and even discourages women from breastfeeding their children.

New York Penal Law

§ 245.00 Public lewdness. A person is guilty of public lewdness when he intentionally exposes the private or intimate parts of his body in a lewd manner or commits any other lewd act (a) in a public place, or (b) in private premises under circumstances in which he may readily be observed from either a public place or from other private premises, and with intent that he be so observed.

Public lewdness is a class B misdemeanor.

 

Nothing in this section shall prevent the adoption by a city, town or village of a local law prohibiting exposure of a person as herein defined in a public place, at any time, whether or not such person is entertaining or performing in a play, exhibition, show or entertainment.

    [NAC NOTE: People v. Santorelli restricts the applicability of § 245.01. The Court of Appeals of New York ruled in 1992 that exposure of a bare female breast violates this law only when it takes place in a commercial context. As a practical matter, proper enforcement of this section can be a problem, since local enforcement agents are often unfamiliar with the case law that interprets the statutory language.]

§ 245.02 Promoting the exposure of a person. A person is guilty of promoting the exposure of a person when he know- ingly conducts, maintains, owns, manages, operates or furnishes any public premise or place where a person in a public place appears in such a manner that the private or intimate parts of his body are unclothed or exposed. For purposes of this section, the private or intimate parts of a female person shall include that portion of the breast which is below the top of the areola. This section shall not apply to the breastfeeding of infants or to any person entertaining or performing in a play, exhi- bition, show or entertainment.

Promoting the exposure of a person is a violation.

Nothing in this section shall prevent the adoption by a city, town or village of a local law prohibiting the exposure of a person substantial- ly as herein defined in a public place, at any time, whether or not such person is entertaining or performing in a play, exhibition, show or entertainment.

§ 245.10 Public display of offensive sexual material; definitions of terms. The following definitions are applicable to section 245.11:

    1. "Nudity" means the showing of the human male or female genitals, pubic area or buttocks with less than a full opaque covering, or the showing of the female breast with less than a fully opaque covering of any portion thereof below the top of the nipple, or the depiction of covered male genitals in a discernibly turgid state.

    2. "Sexual conduct" means an act of masturbation, homosexuality, sexual intercourse, or physical contact with a person's clothed or unclothed genitals, pubic area, buttocks or, if such person be a female, breast.

    3. "Sado-masochistic abuse" means flagellation or torture by or upon a person clad in undergarments, a mask or bizzare costume, or the condition of being fettered, bound or otherwise physically restrained on the part of one so clothed.

    4. "Transportation facility" means any conveyance, premises or place used for or in connection with public passenger transportation, whether by air, railroad, motor vehicle or any other method. It includes aircraft, watercraft, railroad cars, buses, and air, boat, railroad and bus terminals and stations and all appurtenances thereto.

§ 245.11 Public display of offensive sexual material. A person is guilty of public display of offensive sexual material when, with knowledge of its character and content, he displays or permits to be displayed in or on any window, showcase, newsstand, display rack, wall, door, billboard, display board, viewing screen, moving picture screen, marquee or similar place, in such manner that the display is easily visible from or in any: public street, sidewalk or thoroughfare; transportation facility; or any place accessible to members of the public without fee or other limit or condition of admission such as a minimum age requirement and including but not limited to schools, places of amusement, parks and playgrounds but excluding rooms or apartments designed for actual residence; any pictorial, three-dimensional or other visual representation of a person or a portion of the human body that predominantly appeals to prurient interest in sex, and that:

    (a) depicts nudity, or actual or simulated sexual conduct or sado-masochistic abuse; or

    (b) depicts or appears to depict nudity, or actual or simulated sexual conduct or sado-masochistic abuse, with the area of the male or female subject's unclothed or apparently unclothed genitals, pubic area or buttocks, or of the female subject's unclothed or apparently unclothed breast, obscured by a covering or mark placed or printed on or in front of the material displayed, or obscured or altered in any other manner.

Public display of offensive sexual material is a Class A misdemeanor.
